These Terms & Conditions (“Terms”) govern your use of the DM Finds & Creations website and marketplace platform. By accessing or using our website, you agree to these Terms.

1. DEFINITIONS

  • “Company,” “we,” “our,” “us” = DM Finds & Creations
  • “Platform” = The WordPress/WooCommerce marketplace
  • “Customer” = Any user purchasing products
  • “Vendor” = Any seller using the marketplace
  • “User” = Any visitor, customer, or vendor

2. PLATFORM OVERVIEW

DM Finds & Creations operates a multi-vendor marketplace powered by WooCommerce and WCFM Marketplace, allowing independent vendors to:

  • List and sell products
  • Fulfill orders
  • Communicate directly with customers
  • Manage inventory and pricing

👉 We do not own or manufacture all products sold unless explicitly stated.

3. USER ELIGIBILITY

You must:

  • Be at least 18 years old
  • Provide accurate information
  • Use the platform lawfully

We reserve the right to suspend or terminate accounts for violations.

4. CUSTOMER TERMS

4.1 Orders & Purchases

When placing an order, you agree to:

  • Provide complete and accurate billing/shipping information
  • Pay all applicable charges
  • Comply with vendor-specific policies (if applicable)

Orders are subject to acceptance, availability, and fraud review.

4.2 Payments

We accept payments through:

  • Stripe
  • Affirm, Klarna, Afterpay (Buy Now, Pay Later)
  • Cash App Pay
  • WooPay
  • Apple Pay, Google Pay
  • Amazon Pay

By using these methods, you agree to:

  • Their separate terms and privacy policies
  • Possible identity or credit verification

👉 We do not control financing decisions made by BNPL providers.

4.3 Pricing & Errors

We reserve the right to:

  • Correct pricing errors
  • Cancel orders due to incorrect pricing or availability

4.4 Shipping & Delivery

Shipping is handled by vendors or the Company:

  • Delivery times are estimates only
  • We are not responsible for carrier delays
  • Risk of loss transfers upon delivery (or shipment where applicable)

4.5 Returns & Refunds

Returns may be governed by:

  • Company policies
  • Individual vendor policies

Customers must review product-specific terms before purchase.

5. VENDOR TERMS (WCFM MARKETPLACE)

5.1 Vendor Registration

Vendors must:

  • Provide accurate business information
  • Comply with applicable laws
  • Maintain updated account details

5.2 Vendor Responsibilities

Vendors are solely responsible for:

  • Product listings (accuracy, legality)
  • Pricing and inventory
  • Order fulfillment and shipping
  • Customer service and communication
  • Compliance with consumer protection laws

5.3 Vendor–Customer Communication

The platform allows:

  • Direct messaging
  • Product inquiries
  • Customer support communications

👉 Vendors must:

  • Communicate professionally
  • Protect customer data
  • Use data only for order fulfillment

5.4 Prohibited Vendor Conduct

Vendors may NOT:

  • Sell illegal or counterfeit items
  • Misrepresent products
  • Use customer data for unauthorized purposes
  • Circumvent the platform to complete sales

5.5 Vendor Payments & Payouts

Vendors receive payments through:

  • Platform-defined payout systems
  • Integrated payment gateways

We may:

  • Hold funds for fraud investigation
  • Deduct fees or chargebacks

6. INTELLECTUAL PROPERTY

All content on the site (excluding vendor content), including:

  • Logos
  • Branding
  • Website design

is owned by DM Finds & Creations.

Vendors retain rights to their content but grant us a license to display and promote it.

7. USER ACCOUNTS

Users are responsible for:

  • Maintaining confidentiality of login credentials
  • All activity under their account

We may suspend or terminate accounts for violations.

8. PROHIBITED USES

You may NOT:

  • Use the platform for illegal activities
  • Attempt unauthorized access
  • Interfere with platform functionality
  • Upload malicious code

9. DISCLAIMERS

9.1 Marketplace Disclaimer

We act as a platform provider only.

We are NOT responsible for:

  • Vendor product quality
  • Vendor conduct
  • Vendor fulfillment delays

9.2 No Warranty

The platform is provided “as is” without warranties of any kind.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability will not exceed the amount paid for the transaction

11. INDEMNIFICATION

Users agree to indemnify and hold harmless DM Finds & Creations from claims arising from:

  • Misuse of the platform
  • Violation of these Terms
  • Vendor product issues

12. PRIVACY

Your use of the platform is also governed by our Privacy Policy.

13. TERMINATION

We may suspend or terminate access at any time if:

  • Terms are violated
  • Fraud or abuse is suspected

14. DISPUTES

14.1 Customer–Vendor Disputes

Customers should first contact the vendor directly.

We may intervene at our discretion but are not obligated to resolve disputes.

14.2 Governing Law

These Terms are governed by the laws of the State of Texas.

15. CHANGES TO TERMS

We may update these Terms at any time.
Continued use constitutes acceptance of updated Terms.
